Welcome to Majira Wilds®. These Terms of Service ("Terms," "Agreement") govern your access to and use of our website, online store, and any products, services, or content made available (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree, you may not access or use the Services.

Majira Wilds® is owned and operated by Majira Wilds Ltd Co. ("we," "us," "our"). Our Services are powered by Shopify.

1. Eligibility

You must be:

  • At least the age of majority in your state or province of residence, and

  • Legally capable of entering into binding contracts.

By using the Services, you represent that all information you provide is true and accurate.

2. Use of the Services

You agree not to:

  • Use the Services for any unlawful or fraudulent purpose

  • Interfere with the security or functionality of the Services

  • Copy, reproduce, resell, distribute, or exploit any portion of the Services without express written permission

  • Upload malicious code, viruses, or harmful materials

  • Misrepresent your identity or impersonate another person

Violation of these Terms may result in termination of your access to the Services.

3. Product Information, Availability & One-of-a-Kind Items

3.1 Product Descriptions & Variations

We make every effort to accurately describe and photograph our products. However:

  • Colors may vary due to lighting and screen differences

  • Natural variations are expected in one-of-a-kind florals, botanicals, eco-printed textiles, and handmade items

  • Sizes may vary slightly due to the handcrafted nature of certain pieces

These variations are not considered defects.

3.2 One-of-a-Kind & Custom Creations

Many Majira Wilds® pieces bloom only once: unique floral arrangements, botanical art, eco-printed textiles, and custom commissions. You acknowledge and agree that:

  • These items are Final Sale

  • They may not be returned, exchanged, or canceled once created

  • Availability is extremely limited and may change without notice

If an item becomes unavailable after purchase, you will receive a full refund.

3.3 Donation-Based Products

Certain products and sponsorships, such as Giving Blooms by Majira Wilds® or other philanthropic items, support charitable or donation-based initiatives. You acknowledge that:

  • Donations are final

  • Donation-based items are Final Sale

  • We do not issue tax receipts unless explicitly stated

3.4 Wedding, Custom & Event Services

Wedding services, custom commissions, B2B orders, and studio events or workshops may be subject to a separate signed agreement or event terms. Where those terms apply, they govern in the event of a conflict with these Terms.

4. Orders, Payment & Billing

4.1 Order Acceptance

Your order is an offer to purchase. We reserve the right to:

  • Accept or reject any order for any reason

  • Cancel or limit quantities

  • Refuse service to anyone at any time

Reasons may include product availability, errors, suspected fraud, or misuse of the Services.

4.2 Pricing Errors

In the event of a pricing or typographical error:

  • We may cancel the order

  • You will receive a full refund

  • We are not obligated to honor incorrect prices

4.3 Payment Authorization

You authorize us (and Shopify) to charge your chosen payment method for the total amount of your order, including taxes and applicable shipping fees.

5. Shipping

Our complete Shipping Policy is incorporated into these Terms. By placing an order, you acknowledge and agree to the terms in our Shipping Policy. Key notes:

  • We currently ship within the United States only

  • Delivery timelines are estimates and not guarantees

  • Once a package is marked "Delivered," responsibility shifts to the customer

  • Lost or delayed packages will be handled in partnership with the carrier

6. Returns, Exchanges & Store Credit

Our complete Returns, Exchanges & Store Credit Policy is incorporated into these Terms. You acknowledge that:

  • We do not offer refunds; approved returns are issued as store credit

  • Eligible items must be returned within 14 days of delivery

  • One-of-a-kind items, custom creations, eco-printed pieces, Giving Blooms by Majira Wilds® items, Rooted Aromatics™ and personal care products, sale items, gift cards, and event tickets are Final Sale

  • Return shipping and original shipping fees are the customer's responsibility unless the error is ours

  • Damaged or incorrect orders must be reported within 7 days of delivery

7. Rooted Aromatics™ & Personal Care Disclaimer

Rooted Aromatics™ products, including mists and sprays, wellness rollers, diffusers, candles, and smudge sets, are handcrafted with essential oils, fragrance, and botanicals. By purchasing these products, you acknowledge and agree:

  • Patch testing is recommended before applying any product to skin

  • Products must be kept away from eyes, broken skin, children, and pets

  • Candles, sage, and palo santo must never be left burning unattended, and should be used on a heat-safe surface away from flammable materials, drafts, children, and pets

  • You assume responsibility for how products are used once received

  • All Rooted Aromatics™ and personal care products are Final Sale

  • We do not guarantee outcomes related to aromatherapy or wellness practices

These products are not intended to diagnose, treat, cure, or prevent any disease.

8. Intellectual Property

All content on the Services, including but not limited to designs, artwork, floral arrangements, photographs, product names, logos, text, packaging, and branding elements, is the exclusive property of Majira Wilds Ltd Co. and is protected by copyright, trademark, and intellectual property laws.

You may not reproduce, copy, sell, publish, distribute, modify, or create derivative works from any of this content without our express written permission.

9. Third-Party Services

The Services are powered by Shopify and may integrate tools or content from other third parties. You acknowledge that:

  • Third-party tools operate independently of Majira Wilds®

  • We are not responsible for their policies, actions, or performance

  • Your use of such tools is subject to their terms and privacy practices

10. Disclaimer of Warranties

The Services and all products are provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that:

  • The Services will be uninterrupted or error-free

  • Products will meet your expectations

  • Colors, textures, or variations will match digital displays exactly

  • Carriers will deliver packages within estimated timeframes

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

11. Limitation of Liability

To the maximum extent permitted by law, Majira Wilds® shall not be liable for any:

  • Indirect, incidental, special, punitive, or consequential damages

  • Loss of data

  • Loss of profits

  • Loss of goodwill

  • Delays or disruptions in shipping

  • Misuse of products (including aromatics, candles, smudge items, or art pieces)

Our maximum liability for any claim shall not exceed the amount paid for the product giving rise to the claim.

Some states do not allow certain limitations; in those cases, the limits apply to the fullest extent allowable.

12. Indemnification

You agree to indemnify and hold harmless Majira Wilds®, its owners, employees, partners, and affiliates from any claim or demand arising out of:

  • Your misuse of the Services

  • Your breach of these Terms

  • Your violation of any law or third-party rights

13. Governing Law

These Terms and any disputes arising from your use of the Services shall be governed by the laws of the State of Georgia, without regard to conflict of law principles. You agree that any legal action will be brought in courts located in Fulton County, Georgia.

14. Changes to These Terms

We may update these Terms from time to time for business, legal, or operational reasons. When we do:

  • We will update the Last updated date

  • Posting the revised Terms will constitute notice

  • Continued use of the Services means you accept the updated Terms
