Welcome to Majira Wilds®. These Terms of Service (“Terms,” “Agreement”) govern your access to and use of our website, online store, and any products, services, or content made available (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

Majira Wilds® is owned and operated by Majira Wilds LLC (“we,” “us,” “our”).

1. Eligibility

3. Product Information, Availability & One-of-a-Kind Items

3.1 Product Descriptions & Variations

We make every effort to accurately describe and photograph our products.
However:

• Colors may vary due to lighting and screen differences
• Natural variations are expected in one-of-a-kind florals, botanicals, eco-printed textiles, and handmade items
• Sizes may vary slightly due to the handcrafted nature of certain pieces

These variations are not considered defects.

3.2 One-of-a-Kind & Custom Creations

Many Majira Wilds® pieces bloom only once—unique floral arrangements, botanical art, eco-printed textiles, and custom commissions.

You acknowledge and agree that:

• These items are Final Sale
• They may not be returned, exchanged, or canceled once created
• Availability is extremely limited and may change without notice

If an item becomes unavailable after purchase, you will receive a full refund.

3.3 Donation-Based Products

Certain products, such as Giving Blooms™ or other philanthropic items, support charitable or donation-based initiatives.

You acknowledge that:

• Donations are final
• Donation-based items are Final Sale
• We do not issue tax receipts unless explicitly stated

4. Orders, Payment & Billing

4.1 Order Acceptance

Your order is an offer to purchase. We reserve the right to:

• Accept or reject any order for any reason
• Cancel or limit quantities
• Refuse service to anyone at any time

Reasons may include product availability, errors, suspected fraud, or misuse of the Services.

4.2 Pricing Errors

In the event of a pricing or typographical error:

• We may cancel the order
• You will receive a full refund
• We are not obligated to honor incorrect prices

4.3 Payment Authorization

You authorize us (and Shopify) to charge your chosen payment method for the total amount of your order, including taxes and applicable shipping fees.

5. Shipping

Our complete Shipping Policy is incorporated into these Terms. By placing an order, you acknowledge and agree to the terms in our Shipping Policy.

Key notes:

• We currently ship within the United States only
• Delivery timelines are estimates and not guarantees
• Once a package is marked “Delivered,” responsibility shifts to the customer
• Lost or delayed packages will be handled in partnership with the carrier

6. Returns, Exchanges & Refunds

Our complete Returns, Exchanges & Refunds Policy is incorporated into these Terms.

You acknowledge that:

• We offer a 10-business-day return window for eligible items
• One-of-a-kind items, custom creations, eco-printed pieces, donation-based items, sale items, and used personal care products are Final Sale
• Return shipping may be deducted from refunds unless the error is ours
• Shipping fees are non-refundable

7. Scent Mists & Personal Care Disclaimer

Majira Wilds® Cleansing + Scent Mists and similar items are handcrafted with essential oils and botanicals.
By purchasing these products, you acknowledge and agree:

• Allergy Patch Testing is recommended before use
• Products must be kept away from eyes, broken skin, children, and pets
• You assume responsibility for how the product is used once received
• Opened or used mists cannot be returned
• We do not guarantee outcomes related to aromatherapy or wellness practices

These products are not intended to diagnose, treat, cure, or prevent any disease.

8. Intellectual Property

All content on the Services—including but not limited to:

• Designs
• Artwork
• Floral arrangements
• Photographs
• Product names
• Logos
• Text
• Packaging
• Branding elements

—is the exclusive property of Majira Wilds® and protected by copyright, trademark, and intellectual property laws.

You may not:

• Reproduce
• Copy
• Sell
• Publish
• Distribute
• Modify
• Create derivative works

without our express written permission.

9. Third-Party Services

The Services are powered by Shopify and may integrate tools or content from other third parties.

You acknowledge that:

• Third-party tools operate independently of Majira Wilds®
• We are not responsible for their policies, actions, or performance
• Your use of such tools is subject to their terms and privacy practices

10. Disclaimer of Warranties

The Services and all products are provided “as is” and “as available,” without warranties of any kind, whether express or implied.

We do not warrant that:

• The Services will be uninterrupted or error-free
• Products will meet your expectations
• Colors, textures, or variations will match digital displays exactly
• Carriers will deliver packages within estimated timeframes

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

11. Limitation of Liability

To the maximum extent permitted by law, Majira Wilds® shall not be liable for any:

• Indirect, incidental, special, punitive, or consequential damages
• Loss of data
• Loss of profits
• Loss of goodwill
• Delays or disruptions in shipping
• Misuse of products (including scent mists or art pieces)

Our maximum liability for any claim shall not exceed the amount paid for the product giving rise to the claim.

Some states do not allow certain limitations; in those cases, the limits apply to the fullest extent allowable.

12. Indemnification

You agree to indemnify and hold harmless Majira Wilds®, its owners, employees, partners, and affiliates from any claim or demand arising out of:

• Your misuse of the Services

These Terms and any disputes arising from your use of the Services shall be governed by the laws of the State of Georgia, without regard to conflict of law principles.

You agree that any legal action will be brought in courts located in Fulton County, Georgia.
